When Your Business Becomes a Creditor in a Bankruptcy

We represent creditors as well as unsecured creditor committees in matters arising under the Bankruptcy Code.  If you or your business is owed money by a debtor in bankruptcy, we may be able to recover assets or collateral. Some of the services we offer are as follows:

Proofs of Claim

We can assist you or your business in filing a proof of claim in the debtor’s bankruptcy in order to preserve your rights to share in the proceeds of the bankruptcy estate.

Adversary Complaints

We can file adversary proceedings against the debtor, such as actions to keep certain debts from being discharged in the bankruptcy or actions to prevent all debts from being discharged.

Relief from Stay

We can seek relief from the automatic bankruptcy stay in order to allow you or your business to pursue foreclosure on real property, repossession, or the sale of secured collateral.

Objections to Plan

We can assist you and your business in objecting to confirmation of a debtor’s proposed plan in bankruptcy under Chapters 11 or 13.

Defending Claims

We can defend claims brought against you or your business by the debtor in bankruptcy or by the bankruptcy trustee.
